Defendant in error, the Gamble-Robinson Commission Company, (hereafter called plaintiff,) sued in the municipal court of Chicago plaintiff in error, the Union Pacific Railroad Company, (hereafter called defendant,) to recover damages claimed to have been sustained to fruit shipped in twenty cars from Ogden, Utah, to different points in Minnesota, South Dakota and Iowa, one car shipped from Ogden to Omaha and one from Riverdale, Utah, to Minneapolis.
