1Opinion of the CourtFullerton, J.
— The appellant, Earl Martin, was injured, while upon the Pacific highway, by a passenger stage operated by the respondent, Puget Sound Electric Railway. He instituted the present action to recover for his injuries, and on a trial in the court below before a jury a verdict was returned in his favor. On motion, the trial court entered a judgment for the respondent notwithstanding the verdict. The appeal is from the judgment so entered.
