Appeal from Special Term. Action by Adolph Pavenstedt against the New York Life Insurance Company. From an order striking out a portion of the complaint, plaintiff appeals. Reversed.

The complaint avers: That on or about the 22d day of May, 1902, at the city of Bucaramanga, United States of Colombia, the defendant made and delivered to one Gonsalez its certain negotiable bill of exchange or draft in writing, whereby it required itself to pay to the order of said Gonsalez, in New York, $4,181.60. That on or about the 23d day of May, 1902, the said Gonsalez, at Bucaramanga, indorsed, sold, and delivered said bill of exchange to Breuer, Moller & Co., of Bucaramanga, and received in consideration therefor $234,169.60 in the money of the United States of Colombia; $1 of the…
