This action was brought in '.a Justice’s Court to recover the value - of the contents of a trunk, claimed to have been stolen therefrom while in charge of defendant at its station at Tupper Lake Junction^ Judgment was rendered upon the trial before the justice, without a. jury, for the sum of $44 damages and $3,95 costs, from which judgment the defendant appeals. ■ l ¡.

The defendant operates a line of railroad, extending from Hew York city to Loon Lake and beyond. On the 7th day of October, 1897,. the plaintiff was in the employ of the defendant ,as a laborer upon defendant’s road. Upon that day he quit defendant’s employ and. remained at Loon Lake station until about the 18th day of October upon which day he caused his trunk to be checked at Loon Lake station for Tupper Lake Junction without first having purchased a ticket for his own passage between said stations.
