The case now before the court stands in this position: The plaintiff, a resident of the state of New Xork, and of the Southern district of New' York, brought his action in this court against a common carrier by sea (having its domicile in a foreign country), to recover damages for personal injuries to him while a passenger and for the loss of his baggage. The plaintiff has made out his prima facie case.
