*1225Appeal from an order of the Supreme Court, Monroe County (Matthew A. Rosenbaum, J.), entered October 4, 2005 in a personal injury action. The order, among other things, granted plaintiffs’ cross motion for partial summary judgment.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
