This was an action for personal injuries claimed to have been sustained by the plaintiff while riding as a passenger in a taxicab operated by the defendant in the city of Wichita. The trial resulted in a judgment for the plaintiff, and defendant appeals.

The accident occurred near the intersection of Twenty-first street and Waco avenue. Twenty-first street runs east and west and Waco avenue runs north and south. Plaintiff was riding in a taxicab of the defendant going west on Twenty-first street. As the driver of the taxicab entered the…
