LEWIS, Circuit Judge.
Appellant, who was plaintiff below, is the relict of William 1'. Jennings, who died testate while seized in fee of 160 acres of farm lands in Harlan County, Nebraska.
Clause 3 of his will reads:
“I give and bequeath to my beloved wife, Nellie B. Jennings, sill of my real estate of which I may die seized, and at her death, I direct that, what is left of the same, shall go to my beloved daughter, Josie B.
