This is an action on a policy of life insurance, in which defendant in error, plaintiff below, is the beneficiary. From, a judgment in favor of plaintiff for the amount of the policy, plaintiff in error, defendant below, brings this proceeding in error. The policy was taken out by Elizabeth Prater, plaintiff’s mother, on the 19th day of December, 1905, who died on the 17th day of February, 1906. The insurance order by its answer admits-the execution and delivery of the policy and the death of the insured, but denies liability under the policy upon several grounds. Hnder the state of the…
