At the time this complaint was filed on October 25, 1976, 1 plaintiffs in this class action were all incarcerated prisoners at the Delaware Correctional Center (“DCC”) in Smyrna, Delaware. Invoking the Eighth and Fourteenth Amendments, 42 U.S.C. § 1983 and several state laws governing corrections, their complaint sought permanent injunctive relief to alleviate the overcrowding of prisoners at DCC.
