WORVERTON, District Judge.

The facts relevant and material to an understanding of the issues involved by the present controversy are, in brief, as follows: The Blackfeet Indian reservation, by its present boundaries, was established by a convention with the Indians, as shown by Act Cong. May 1, 1888, c. 213, 25 Stat. 113, 129. Birch creek forms its southern and southeasternmost boundary; the line of separation being in the center of the' stream. This creek has its source by several branches in the Rocky Mountains, and traverses public lands of the United States before it touches the reserve,…
