On and for some time prior to the 28th day of August, 1916, W'm. R. and James E. McDowell were the owners, each of an undivided one-half interest in a tract of land in Hyde county. On said date they executed and delivered to Drake & Ballard Investment Company a mortgage to secure the sum of $7,000. On the 14th of October, 1920, James E. McDowell conveyed his undivided one-foalf interest in said land, subject, of course, to said' $7,000 mortgage, to his wife, Marie McDowell. Thereafter James E.
