delivered the opinion of the court;

The defendant, Cornelius Carmickle, was convicted in the Circuit Court of Peoria County of arson and murder and direct appeal of those convictions was taken to this court. This court vacated the conviction of arson and affirmed the murder conviction and the sentence of imprisonment of not less than 50 nor more than 150 years imposed thereon. (People v. Carmickle (1977), 46 Ill. App. 3d 112, 360 N.E.2d 794.) Subsequent to his appeal, to-wit, on August 1,1978, the defendant filed a pro se petition for post-conviction relief. Private…
