MEMORANDUM DECISION ON OBJECTION TO DEBTOR’S DISCHARGE

Tzvi Nof (“Nof’) seeks judgment pursuant to §§ 727(a)(3), (a)(4)(A), (a)(4)(D) and (a)(5) of the Bankruptcy Code (“Code”) denying Chaim Gannon (“Gannon” or “debtor”) his discharge in bankruptcy. Alternatively, he requests that his undisputed debt of $39,-987.50 be declared nondisehargeable pursuant to §§ 528(a)(2)(B) and/or 523(a)(6) of the Code.
