This writ brings up the proceedings of the board of street and water commissioners of Jersey City in *143relation to Chapel avenue, a public street in Jersey City. This avenue was dedicated fifty feet 'in width and extended from Garfield avenue easterly, to the shore of the New York bay. A grade was adopted for the avenue some years ago, ■but it has never been worked to grade. Though it has been used, it has not been used to its full width.
