Appeal from decree of circuit court of Westmoreland county, rendered 18th April, 1881, in the two cases of BrockenbrougTi v. Turner and als., and. of Harding’s Ex’or v. Borne, heard together.

Frances A. Cox died in the year 1859, leaving a will, in which she bequeathed to Elizabeth Pearson an annuity of three hundred dollars for her life, and directed her executors, James Smith and Thomas Brown, to invest a sum sufficient to insure, from the interest thereof, the regular payment of the annuity. After the death of Mrs. Pearson, the sum so invested was directed to be equally divided between Sarah Ann Richards, Jane E. Rogers, Thomas N. Murphy, Mary McGuire and John N. Murphy. The said •executors qualified, with R. L. T. Beale, B. F. Brown and Willoughby Newton as their securities.…
