Parsley v. Commonwealth
Court of Appeals of Kentucky (pre-1976)
1Opinion of the Court
CAMMACK, Judge.
The appellants, Brooks Parsley, William (Bill) Parsley, Jr., and Robert (Bob) Bal-lenger, were indicted jointly for the crime of maliciously striking and wounding Cookie Durham with intent to kill. At their joint trial all were convicted and sentenced to confinement in the penitentiary for two years. It is argued on this appeal that (1) William Parsley and Robert Ballenger should have been given a directed verdict of acquittal; and (2) the verdict is flagrantly against the evidence as to all three of the appellants and therefore they were entitled to a directed verdict.
