Affirming.

Homer Hale appeals from a judgment convicting' Pirn of manslaughter and fixing his punishment at 10 years ’ imprisonment.

The homicide occurred about 10 o ’clock on the night of August 9, 1933, at the Evergreen Inn, which is located about two miles fronvMiddlesboro. There were several guests present, some of whom were dancing, and others were seated on benches or standing around on the outside of the building.
