Following a bench trial, Robert Lee Simmons was convicted of driving under the influence to the extent it was less safe for him to drive (“DUI less safe”),1 failure to report an accident resulting in injury or property damage of $500 or more,2 aggressive driving,3 possessing an open container of an alcoholic beverage in the passenger area of a vehicle,4 and operating a motor vehicle without registration or a valid license plate.5 Simmons appeals, arguing that he did not intelligently waive his right to a jury trial.
