Appeal by the defendant, The New Amsterdam National Bank of New York, from a final judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 15th day of April, 1908, upon the decision of the court rendered after a trial at the New York Trial Term, a jury havin'g been waived.

Clarke, J.:

Plaintiff and defendant are members of the New York Clearing House Association, .instituted to facilitate banking transactions in the city of New York. Its scheme of operation is clearly described in Mt. Morris Bank, v. Twenty-third Ward Bank (172 N. Y. 244), as follows: “ That association appears by its constitution to have adopted a very simple manner of settling the drafts, checks and other claims of its various members against the others. Each member, every morning, delivers to the clearing house the cheeks, drafts and notes it holds against the other banks and receives credit…
