This action was instituted in the Common Pleas Court of Jackson County by the plaintiff, Phillip Lakes, the appellant herein, against the Buckeye State Mutual Fire-Insurance Association, the defendant, on a fire insurance policy issued by *116the defendant association to the plaintiff on March 2,1953.
