On September 21, 1972 the Clerk of this court received a copy of a petition for writ of mandamus filed by the defendant in the above-captioned case in the United States Court of Appeals for the First Circuit. In a memorandum and order entered on September 28, 1972, the Circuit Court of Appeals de*202nied defendant’s petition and suggested that he file a motion to dismiss the indictment, pursuant to Rule 12 of the Federal Rules of Criminal Procedure, with the district court.
