This is an appeal from the East Orange District Court, sitting without a jury. The plaintiff recovered a judgment against the defendant for rent for the months of June, July and August, 1910.

The state of the case discloses the following facts: One Herbert Eawson leased, in writing, a certain apartment to the defendant for a period of seven months from March 1st, 1909, at $39 a month. On the 29th of July, 1909, Eawson assigned the lease to the plaintiff, to whom the defendant attorned. The lease, among other things, provided: “In case said…
