The plaintiff in error, as plaintiff, instituted this action against the defendant in error in the court of common pleas o£ Tulsa county on the 8th day of February, 1926, to recover the sum of $2,434.70 on account of certain goods sold and delivered to the defendant. The parties will be referred to as they appeared in the trial court.

The plaintiff sued on an attachment which was levied upon certain personal property belonging to the defendant, which had been theretofore sold and delivered to it by the plaintiff. Thereafter the defendant filed its motion to discharge the…
