HOLLAND, District Judge.

The Trust Company in this case, assignee of the subscription agreement of an underwriting syndicate to bonds of the Tube Company, brings suit against the defendant, one *520of the subscribers to these bonds, to recover the sum of $13,000, with interest thereon from December 15, 1903, less a credit of $1,950 as of June 20, 1904.
