The Director of Revenue (the “Director”) appeals a trial court judgment setting aside the revocation of Eric Courtney’s (“Courtney”) driving privileges. The Director argues that the trial court erred in excluding the results of Courtney’s breath test for the stated reason that there was no evidence that the simulator for the breath testing device had been calibrated against a'National Institute of Standards and Technology (“NIST”)approved thermometer in connection with its maintenance'as required by the Department of Health and Senior Services (“DHSS”).
