forty-third judicial district, specially presiding, On September 20, 1940, William B. McClenachan, Jr., District Attorney of Delaware County, presented his petition or suggestion praying as follows:

“Your petitioner, therefore, respectfully prays that your Honorable Court shall direct the issue of a writ of quo warranto directed to the said Clifford H. Peoples to show by what authority he claims to exercise the office of Mayor of the City of Chester in said County of Delaware, and after appropriate proceedings to enter judgment that the said Clifford H.
