This is a bill in equity to' enjoin the members of the town council and the chief of police of Bristol from enforcing the provisions of general laws 1956, §5-16-2, against the complainant. The cause is pending in the superior court on 'bill, answer and oral proof, but in the course of the proceedings a question of law arose which in the opinion of the trial justice was of such doubt and importance and so affected the merits of the controversy that it ought to be determined by the supreme court.
