On December 13, 1913, J. H. Koller, one of the defendants in error, brought suit in the district court of

Kay county, and caused summons to be issued thereon to the defendants in that action, one of whom was Mrs. Viola Russell, whose name at that time was Viola Easterday, she being the wife of J- B. Easterday. John H. Koller, subsequently obtained a judgment in said action against J. H. Easterday and plaintiff in error; she being at that time the wife of J. B. Easterday.
