OPINION

STERN, District Judge.

This is a petition for a writ of habeas corpus to compel the release of George and Eddie Johnson from state custody. Petitioners are brothers. They were jointly indicted for armed robbery, and convicted after jury trial in Superior Court in 1972. Petitioners commenced this lawsuit by filing a joint pro se petition and upon their request, this Court appointed counsel to represent them jointly.
