¶ 1. FH Healthcare Development, Inc. (FHHD), United/Dynacare, LLC, and the City of Wauwatosa (the City) appeal from the trial court's denial of their cross-motions for summary judgment. This court granted the joint petition for interlocutory appeal, pursuant to Wis. Stat. Rule 809.50(2) (2001-02). FHHD and United/Dynacare filed a property tax exemption action, pursuant to Wis. Stat. § 74.35(3)(d), seeking to recover the full amount of taxes paid, which they allege were levied unlawfully, plus interest, from the City.
