In this original proceeding, the City of Houston (the City), relator, urges this court to issue a writ of mandamus to the 215th Judicial District Court directing that court to set aside the portion of its order signed December 19, 1994, entered in trial court cause number 93-23318, styled Elwood Scott, Jr. and Earline T. Scott v.
