Appellant was convicted of murder, and his punishment assessed at twenty-five years confinement in the penitentiary.
This is the second appeal in this case, the opinion of the court on the former appeal being reported in 75 Texas Crim. Rep., 120, 170 S. W. Rep., 719.
There are but four bills of exception in the record, the first contending that the court erred in refusing to quash the special venire summoned in the case, because the return of the officer showed he had not summoned all the jurors issued for, and no sufficient reason stated in the return why they had not been…
