This case involves an appeal by the plaintiff and a cross-appeal by the defendant from orders entered by the District Court of Nebraska, The Honorable C. Arlen Beam, presiding, in a jury trial diversity case which returned a verdict for the defendant. Plaintiff J.E.K. Industries, Inc. (hereinafter J.E.K.) brought a replevin action to recover possession of a 47-foot Blue-water cruiser yacht. Defendant Hal C. Shoemaker (hereinafter Shoemaker) filed a counterclaim for damages.
