The plaintiff in error was convicted in the criminal ' court of Davidson county of murder in second degree for the unlawful killing of one Horace Dozier, and sentenced to the State prison for a term of twenty years. He has appealed in error. The only question made on the appeal is that the prisoner in his trial was denied the *357equal protection of the laws guaranteed to him by the fourteenth amendment to the federal constitution. It is proper, however, before entering upon an examination of the legal question, to make a brief statement of the facts.
