This matter is before us on a writ of error to review judgment of conviction entered in the District Court of Wilkin County on November 15, 1956. Defendant is confined in the State Penitentiary at Still-water. The matter is presented on the original files in the lower court together with the transcript of proceedings at the time sentence was imposed as well as the briefs of defendant and the attorney general.
