OPINION OF THE COURT BY

WHITING, J.

This is an action for malicious prosecution. The jury rendered a verdict for the plaintiff for $2,000; defendant’s motion for a new trial was granted by the trial judge on the ground of excessive damages, and the new trial was limited to the sole issue of the quantum of damages. Both parties come to this court on bills of exceptions. The plaintiff claims that the trial *768court erred in granting a new trial, and the defendant claims that a new trial should have been ordered without any limitations as to the issues.
