Appeal by the defendant, Leontine Klein, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Orange on the 9th day of August, 1912, upon the verdict of a jury rendered by direction of the court.

Carr, J.:
On the trial of this action both parties made a motion for a direction of a verdict. The trial court directed a verdict in favor of the plaintiff, and judgment was entered thereon, from which the defendant now appeals. The plaintiff carried on a *380tailoring business in the city of Newburgh, and the defendant carried on a dyeing and cleaning business in the borough of Brooklyn, city of New York.
