Plaintiffs in these companion equity actions have filed lengthy complaints setting forth various alleged bases for the invalidity of the defendant city’s proposed universal water metering program. The city filed preliminary objections to each of the complaints, which objections we refused, deeming it more appropriate that the parties be given a full opportunity to develop the factual background preparatory to consideration of some of the constitutional questions involved. The matter came on for trial before two judges sitting as a court in equity on January 18,19 and 22,1954.…
