This suit was instituted in 1870, at the October term of the circuit court of St. Louis. It was tried at the October term, 1873, before Judge Lindley, and the petition was dismissed, and a decree made to that effect. A motion for rehearing during that term was overruled at the June term, 1874. At the general term of said circuit court, held during the same month, this decree at the special term was affirmed and appeal taken by the plaintiffs. The object of the suit was to have a deed which had been executed by Sarah Patton on the 17th of January, 1866, set aside, and declared of no validity.…
