OPINION
BAUMAN, District Judge.
This is an action for trademark infringement and unfair competition, brought pursuant to the Lanham Act, 15 U.S.C. § 1051 et seq., § 368-d of the General Business Law of New York, McKinney’s Consol.Laws, c. 25, and the common law of unfair competition. Jurisdiction is properly vested in this court pursuant to 15 U.S.C. § 1121 1 and 28 U.S.C. § 1338. 2 The case was tried before this court, sitting without a jury, and what follows constitutes my findings of fact and conclusions of law pursuant to Rule 52(a) of the Federal Rules of Civil Procedure.
