Plaintiff, Manuel Creppel, injured his back on August 6,1992 while working as a tugboat captain aboard the vessel MTV John 1:1. The vessel was owned by American Tugs, Inc., which was owned by Autrey Dufrene. Plaintiff filed his Jones Act1 claim in state court against the MTV John 1:1 in rem and American Tugs in personam. After a bench trial, the trial court issued a judgment on December 20,1994, finding the plaintiff 50% at fault for his injuries, due to his knowledge of the boat’s condition, his responsibility as captain of the vessel to keep the vessel in…
