The appellant, Perry McFarland, stands convicted of the first degree murder of one Rachelle Gaines. Testimony at trial revealed that the Appellant had been romantically involved with the decedent and that the two of them had at one time lived together. On January 28, 1974, the decedent, with her daughters and some friends, was moving into a new apartment. The Appellant came to this apartment and shot the decedent with a .22 caliber pistol.
