This is a prosecution by an information containing two counts for the violation of a provision of the motor vehicle law. There was a trial by jury in the Rutland municipal court that resulted in a verdict of “not guilty” on the first count and a verdict of “guilty” on the second count. Judgment was rendered on the verdict of “guilty,” and sentence was imposed. The respondent excepted.
