O’TOOLE, District Judge.
The magistrate judge to whom this matter was referred has filed a Report and Recommendation with respect to the respondent’s motion to dismiss or alternately for summary judgment. The petitioner objects to the Report and Recommendation for three reasons.
He first contends that his security classification as a sex offender violates his due process rights under the Fifth Amendment *172because it will “affect the duration of his sentence” by decreasing the likelihood of placement in a halfway house.
