The Peoples Bank of Sanford, a corporation, instituted an action of assumpsit against D. A. Caldwell, D. D. Caldwell and H. W. Caldwell, trading and doing business under the-firm name and style of D. A. Caldwell & Sons, and against D. A. Caldwell, D. D. Caldwell, and H. W. Caldwell, individually, and as ancillary thereto also instituted attachment proceedings.
