Action by appellant to recover a balance due on a promissory note signed and executed jointly by the respondents, 'Miller and his ¡wife, to the Farmers’ and Merchants’ State Bank of Hecla, S. D. The bank failed, and Smith, as superintendent of the banks of the state of South Dakota, brought action against Miller and wife jointly.
