Background
This matter is before the Court on the Court’s order “to show cause under Rule 9011 why [Attorney Michael Howard] should not be sanctioned for filing an opposition (Document #27) without any basis in fact.” The Court held a hearing on the Chapter 13 Trustee’s Motion to Dismiss the Case pursuant to § 1307(c)(4) of the Code. The Debtor’s attorney, Michael Howard, filed an Objection to the Motion in which the allegations of Paragraph 4 of the Motion were denied. Paragraph 4 of the motion states: “The Debtor is in arrears…
