Ivey v. State

District Court of Appeal of Florida

Decided August 17, 2016No. 3D15-1981Published

1Opinion of the Court

ON MOTION TO DISMISS

LAGOA, J.

Appellant, Mark David Ivey (“Ivey”), seeks review of the trial court’s order denying his motion to correct an illegal sentence under Florida Rule of Criminal Procedure 3.800. Appellee, the State of Florida (the “State”), moves to dismiss this appeal for lack of jurisdiction because the notice of appeal was not timely filed. Because Ivey filed his notice of appeal eight days after the deadline pre- scribed in Florida Rule of Criminal Procedure 3.850(k) and Florida Rule of Appellate Procedure 9.110(b), we grant the State’s motion to dismiss.
