On January 11, 1957, the District Attorney for the First Judicial District filed an original proceeding in this *251court in the nature of quo warranto under Rules 106 and 116 R.C.P. Colo. Named as the defendant was Carl E. Enlow, the person who was then in possession and control of the office of Sheriff of Jefferson County, Colorado.
